A study by the New England Journal of Medicine found that thirteen out of every one hundred patients is subjected to medical malpractice. The American Medical Association acknowledges that 15% of physicians, nurses and hospital personnel are under the influence of drugs and alcohol. Recent Development in Medical Malpractice Legislation The United States' Senate recently voted against the latest attempt to prevent victims of medical malpractice for being adequately compensated for their pain and suffering. Senate Bill 11 if passed, would have capped a victim's non-economic damages at $250,000.00. Proponents of the bill claimed that malpractice costs were making insurance unaffordable for physicians. This is simply untrue.
